CMMC Flow-Down to Subcontractors: What Primes Must Require

How CMMC and DFARS cyber clauses flow to subcontractors — FCI vs CUI, assessment levels, SPRS expectations, and practical contract language themes.

Published: September 2026 Compliance · CMMC 8–12 min read

CMMC is a supply-chain programme. If your subcontractors process, store, or transmit FCI or CUI, the applicable safeguarding and assessment obligations must flow down. This page explains the practical pattern without inventing clause text as legal advice.

Related: CMMC hub · DFARS 7012–7021 · MSPs / ESPs · Level 1 · Level 2.

Not legal advice: Use counsel for clause drafting. Flow-down failures create False Claims Act and contract performance risk for the prime and the sub.

FCI vs CUI Determines the Floor

Information type
Typical CMMC floor
Core requirement set
FCI
Level 1 (Self)
15 FAR 52.204-21 basic safeguarding requirements
CUI
Level 2 (Self or C3PAO when designated)
110 NIST SP 800-171 Rev 2 requirements
High-priority CUI programmes
Level 3 (DIBCAC) when designated
Level 2 + 24 selected NIST SP 800-172 (Feb 2021) requirements

As of September 2026, Phase II suspension means new designations are typically Level 1 (Self) or Level 2 (Self) only — but existing contract language and DFARS 7012 safeguarding still apply. See timeline.

What Primes Typically Flow

Practical Steps

  1. Inventory which subs touch FCI/CUI (including MSPs).
  2. Map each to Level 1 vs Level 2 vs out-of-scope.
  3. Collect SSP summaries / SPRS status where contracts require.
  4. Track annual affirmations and assessment expiration (L2 assessment cadence every 3 years with annual affirmation).

How CyberSilo Helps

Make Flow-Down Auditable

Track which subcontractors touch FCI/CUI and what level they must evidence — before option exercise surprises.

Frequently Asked Questions

Must every subcontractor get Level 2 C3PAO?

No. Level depends on information type and what the solicitation/contract designates. During Phase II suspension, requiring activities may designate only Level 1 (Self) or Level 2 (Self).

Does flow-down apply to MSPs?

Yes when they process, store, or transmit FCI/CUI or provide security protection for those systems. Document shared responsibility.

What if a sub fails Conditional closeout?

Conditional CMMC status (where allowed for L2/L3) requires POA&M closeout within 180 days of the Conditional CMMC Status Date. Missed closeout threatens status — primes should require early notice.
