GDPR International Data Transfers: SCCs, Adequacy and the EU-US Data Privacy Framework

Chapter V governs transfers outside the EEA — adequacy decisions, SCCs, BCRs, and other safeguards, including the EU-US Data Privacy Framework context.

Published: September 2026 Compliance · GDPR 8–12 min read

Chapter V (Articles 44–49) restricts transfers of personal data to third countries unless an adequacy decision exists or appropriate safeguards (such as Standard Contractual Clauses) are in place, subject to Article 49 derogations in limited cases.

Transfer tools: Adequacy (Art 45), appropriate safeguards including SCCs and BCRs (Art 46), and limited derogations (Art 49). Post-Schrems II practice still expects transfer risk assessment alongside SCCs where relevant.

EU–US Context

Transfers to the United States often rely on the EU-US Data Privacy Framework (where the importer is certified) and/or SCCs with supplementary measures as needed. Always verify current Commission adequacy status and importer certification before relying on marketing claims.

Frequently Asked Questions

Are SCCs enough alone?

SCCs are a primary Art 46 tool; practice often still requires assessing third-country law and adding supplementary measures where needed.

What is an adequacy decision?

A European Commission decision under Article 45 that a third country ensures an adequate level of protection.

Can I use consent for all US transfers?

Article 49 consent is constrained (explicit, informed about risks). It is not a scalable substitute for Art 45/46 tools.
